Telehealth Consent
This Telehealth Consent (“Agreement”) governs your access to and use of telehealth services provided by Övie Health Group PLLC (“Övie,” “we,” “us,” or “our”). By accessing or using our telehealth services, creating an account, submitting medical information, or engaging with Providers through the Platform, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this Agreement. If you do not agree to this Agreement, you must immediately discontinue all access to and use of Övie telehealth services.
1. TELEHEALTH SERVICES
1.1. Description of Services.
Telehealth services provided by Övie involve the use of electronic communications technology to deliver medical care and consultations remotely. Such technologies may include, but are not limited to, video conferencing, audio calls, secure messaging, and other forms of digital communication. Services may include review of medical history, clinical assessments, diagnosis when appropriate and feasible via telehealth, development or modification of treatment plans, prescription recommendations, referrals to other healthcare providers, patient education, chronic condition monitoring, and follow-up communications.
1.2. Independent Clinical Judgment.
All clinical decisions, including but not limited to diagnoses, treatment recommendations, prescriptions, and referrals, are made solely by licensed Providers. Övie does not control, direct, or override Provider decisions and does not guarantee any clinical outcomes. You acknowledge and agree that Providers exercise independent professional judgment at all times, and Övie assumes no liability for clinical decisions, outcomes, or any acts or omissions of Providers.
1.3. HIPAA Compliance and Privacy.
Övie maintains and safeguards your Protected Health Information (“PHI”) in compliance with HIPAA, applicable state laws, and professional standards. Your PHI may be collected, stored, transmitted, and used solely for purposes of providing telehealth services and coordinating care. You consent to the use and disclosure of your PHI to affiliated pharmacies, laboratories, healthcare partners, payment processors, and other entities as necessary for your care or for Platform functionality.
2. ELIGIBILITY AND CONSENT
2.1. Age Requirements.
You must be at least eighteen (18) years of age and not older than seventy-five (75) years to access Övie telehealth services. Certain specialized services may require you to meet additional age criteria based on clinical appropriateness. Övie may request documentation to verify your age or legal capacity to consent. We reserve the right to refuse, limit, or discontinue services at any time and for any reason, including but not limited to age, safety, clinical appropriateness, regulatory compliance, or any Provider-determined necessity.
2.2. Self-Pay Services and Medicaid/Medicare Acknowledgment.
All services provided by Övie are offered on a self-pay basis. By proceeding with telehealth services via clickwrap, electronic acknowledgment, or similar means, you consent to pay for all services rendered. You acknowledge that even if you have commercial health insurance or are a beneficiary of Medicare, Medicaid, Tricare, or any other federal or state-funded program, Övie will not submit claims to such programs, and you remain responsible for payment in full. Your election to self-pay is voluntary and constitutes your electronic signature and legal acknowledgment of these terms. Payment for services through affiliated brands does not obligate Övie or Providers to prescribe or deliver any specific medication or treatment. Providers retain independent professional judgment and may modify, refuse, or discontinue prescriptions or services at their discretion.
2.3. Right to Refuse or Discontinue Services.
Övie reserves the right to refuse, limit, or discontinue telehealth services at any time and for any reason, including but not limited to safety concerns, misrepresentation, non-compliance, or any Provider-determined clinical necessity.
2.4. Technology Requirements and Security.
You are solely responsible for maintaining access to the technology necessary to participate in telehealth services, including functioning devices, secure and updated software, and a stable internet connection. You must ensure a private environment for consultations and maintain the security of your login credentials. Övie does not guarantee uninterrupted service or the security of communications through digital platforms.
2.5. Emergency Situations.
Telehealth services are not appropriate for medical emergencies. You must call 911 or seek immediate in-person care in the event of an emergency. Providers may instruct you to do so during any telehealth encounter, and you agree to follow these instructions promptly. Övie assumes no responsibility or liability for consequences resulting from delayed or inadequate emergency care.
2.6. Patient Responsibilities and Rights.
You must provide complete, truthful, and accurate medical and personal information. Misrepresentation or omission of information may result in refusal of services, termination of care, denial of prescriptions, or other safety risks. You have the right to refuse or discontinue telehealth services at any time. You also have the right to access your medical records and request amendments in accordance with applicable law.
3. PRESCRIPTION AND TREATMENT DISCLAIMER
Payment for medications or services through affiliated brands does not guarantee that any Provider will prescribe or deliver a specific treatment. All clinical decisions, including the issuance, modification, or discontinuation of prescriptions or treatment plans, are made solely at the independent professional judgment of the Provider in accordance with applicable laws, regulations, and professional standards.
You acknowledge and agree that:
~ Providers evaluate your health information, medical history, submitted forms, and any available diagnostic or laboratory results to make clinically appropriate recommendations. Treatment decisions are individualized and based on your specific health profile.
~ Övie and its Providers make every effort to provide safe, evidence-based, and clinically sound care; however, telehealth has inherent limitations, including the inability to conduct hands-on examinations, which may impact clinical outcomes. While Providers exercise their professional judgment to minimize risk, no treatment, prescription, or outcome can be guaranteed.
~ Providers may, at their sole discretion and at any time, modify, withhold, or discontinue a prescription or treatment plan if it is deemed unsafe, clinically inappropriate, or inconsistent with professional standards, safety guidelines, or regulatory requirements. Payment for a product or service does not obligate a Provider to issue a prescription or deliver treatment.
~ Övie and its Providers are not responsible for the decisions or actions of affiliated brands, including pharmacies or third-party vendors. While Övie strives to coordinate with affiliated brands to ensure timely delivery of prescriptions and services, delays, errors, stock shortages, or other issues outside of Övie’s direct control may occur.
~ You acknowledge that there are risks inherent in all treatments and medications, including adverse reactions, interactions with other medications, or outcomes that may differ from expected results. You accept responsibility for communicating all medications, supplements, or therapies you are taking to your primary care provider (PCP) to ensure coordinated and safe care. Övie Providers are not your PCP and do not assume ongoing responsibility for your overall healthcare management.
~ You agree to seek immediate emergency medical services by calling 911 or going to the nearest emergency department in the event of a medical emergency, severe reaction, or sudden deterioration of health, even if under telehealth care. Providers may instruct you to do so during any telehealth encounter, and you agree to follow these instructions promptly.
~ Övie and its Providers expressly disclaim liability for any adverse outcomes, complications, or damages arising from treatment decisions, prescriptions, or the actions of affiliated brands or third-party service providers. You agree that your use of telehealth services constitutes acknowledgment of these risks and your acceptance of them.
~ By proceeding with telehealth services, you confirm that you have had the opportunity to ask questions about recommended treatments or prescriptions, and that you understand the limitations, risks, responsibilities, and scope of care associated with receiving telehealth services.
~ By accessing or using Övie telehealth services, you acknowledge that you have read, understood, and accepted these limitations and disclaimers regarding prescriptions, treatment decisions, affiliated brands, telehealth limitations, emergency responsibilities, and the fact that Övie Providers are not your primary care provider. You agree that Övie and its Providers are not responsible for clinical outcomes, and that all care is provided under the exercise of independent professional judgment.
4. RELEASE AND WAIVER
By accessing or using telehealth services, you hereby fully release, discharge, and waive any and all claims, demands, or causes of action of any kind, whether known or unknown, arising out of or relating to the provision of telehealth services by Övie, its Providers, employees, contractors, affiliates, agents, or any affiliated brands. This release and waiver specifically includes, without limitation, claims for professional negligence, malpractice, errors in clinical judgment, prescription or treatment decisions, including denial, modification, or discontinuation of treatment, adverse outcomes, side effects, or complications resulting from medications, treatments, or clinical care, breach of privacy, confidentiality, or security, including electronic communications, PHI handling, or third-party disclosures, and acts or omissions of affiliated brands, pharmacies, laboratories, or other third parties involved in the provision of services. It also applies to any indirect, incidental, special, punitive, or consequential damages related to your use of the telehealth platform or services.
You acknowledge and agree that telehealth services have inherent limitations compared to in-person care, and outcomes cannot be guaranteed. Providers act solely within their independent professional judgment and in accordance with applicable laws, regulations, and professional standards. Övie cannot and does not assume responsibility for any treatment outcome, clinical decision, or action of affiliated brands or third-party providers. Your voluntary use of telehealth services constitutes acceptance of the risks associated with telehealth, prescription management, and treatment decisions.
You are responsible for promptly reporting changes in your health, medications, or conditions to your primary care provider or other treating provider, and for seeking immediate emergency medical care when clinically necessary. This Release and Waiver applies to any and all claims, whether arising in contract, tort, statute, or otherwise, and you expressly waive your right to pursue a lawsuit or class action against Övie, its Providers, affiliates, or agents.
By proceeding with telehealth services, you acknowledge that you have read, understood, and voluntarily agreed to this Release and Waiver. You further acknowledge that this agreement is legally binding and that you assume full responsibility for your decision to receive telehealth services.
5. ACKNOWLEDGMENT AND CONSENT
By accessing or continuing to use Övie telehealth services, you acknowledge that you have carefully read, understood, and voluntarily agreed to all terms outlined in this Agreement. You understand that telehealth services have inherent limitations compared to in-person care, including restrictions on physical examination, diagnostic capabilities, and the ability to provide immediate emergency interventions. You further acknowledge that all Providers exercise independent professional clinical judgment, and that any treatment decisions, prescriptions, or recommendations are made at the sole discretion of the Provider based on the information available and applicable clinical standards. You understand and accept that Övie may refuse, limit, or discontinue services at any time for any reason, including safety concerns, regulatory compliance, misrepresentation, non-compliance, or clinical judgment.
You acknowledge that Övie is not an emergency medical service and does not replace hospital care, urgent care centers, or crisis intervention. In the event of a medical emergency, you must immediately call 911 or seek prompt in-person medical attention. You are responsible for seeking emergency care if your condition requires it, and you agree that Övie assumes no responsibility or liability for delays or inadequate emergency treatment.
You further acknowledge that Övie does not act as your primary care provider and is not responsible for the ongoing management of your overall healthcare. If you do not have a primary care provider, you may contact local resources such as federally qualified health centers or visit platforms like HRSA Find a Health Center (link) or Zocdoc (link) to locate a provider.
You agree that Övie assumes no liability for clinical outcomes, adverse events, complications, or risks associated with any treatment or prescription provided, and is not responsible for the actions or decisions of affiliated brands, pharmacies, or third-party service providers. By proceeding with telehealth services, you voluntarily consent to receive care under these terms, accept the limitations and risks inherent in telehealth, and assume responsibility for your decisions regarding use of these services.
